These Terms & Conditions govern the supply of fumigation and pest management services by TFS Fumigation (“we”, “us”, “our”) to you (the “Client”). By requesting a quote or engaging us to carry out work, you agree to these terms. If we have a separate written agreement with you, that agreement will prevail to the extent of any inconsistency.

Quotes and bookings

Quotes are based on the information you provide and are valid for 30 days unless stated otherwise. A booking is confirmed once we accept your instructions. If the actual scope, commodity, volume or site conditions differ from those quoted, we may adjust the price accordingly and will advise you where practical.

Client responsibilities

To allow us to perform the service safely, lawfully and on schedule, you agree to:

• Provide safe, timely and unobstructed access to the cargo, vessel, structure or premises to be treated;
• Give accurate information about the goods, their contents, packaging and destination requirements;
• Ensure people, pets and livestock are kept clear of treatment areas as directed; and
• Comply with all safety instructions, ventilation periods and re-entry times we specify.

Compliance and certification

We carry out treatments in accordance with applicable Australian standards and, where relevant, the biosecurity requirements of the destination country. Certification is issued on the basis of the treatment performed and the information supplied to us. We are not responsible for delays, rejections or additional costs arising from inaccurate information, changes to importing-country protocols, or matters outside our control.

Pricing and payment

Prices are in Australian dollars and, unless stated otherwise, exclude GST. Payment is due by the date shown on our invoice. We may charge for additional attendances, standby time or re-treatments caused by access issues, incorrect information or circumstances beyond our control. Overdue accounts may incur reasonable recovery costs.

Cancellations and rescheduling

If you need to cancel or reschedule, please give us as much notice as possible. Charges may apply where crew, equipment or materials have already been mobilised or committed for your job.

Liability

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits those rights. To the extent permitted by law, our liability for any claim is limited to re-supplying the relevant service or paying the cost of having it re-supplied, and we are not liable for indirect or consequential loss. We are not liable for pre-existing damage, latent defects, or loss caused by the condition of the goods, cargo or premises, or by factors outside our reasonable control.

Warranty

Where a treatment is warranted, the warranty applies only if the site, cargo or premises are maintained in accordance with our instructions and are not disturbed, reinfested or altered after treatment. Warranties do not cover new activity introduced after we complete the work.

Website content

All content on this website, including text, images, logos and design, is owned by or licensed to TFS Fumigation and may not be copied or reused without our permission.

Privacy

We handle personal information in accordance with our Privacy Policy.

Governing law

These terms are governed by the laws of Australia and the state or territory in which the services are provided, and the parties submit to the jurisdiction of the courts of that place.
